Pet-friendly, oceanfront, with amazing views, this home will win you over instantly.This Ocean View Penthouse II, located in South Mission Beach, offers stunning views, comfortable accommodations, and a great location. This is the perfect place to host a family vacation or enjoy a quiet retreat with friends. Located at the southern tip of Mission Beach, this property is ideally situated for ocean front views without all the craziness of the boardwalk. The beach leads all the way to the front of the building, and it is only a few minutes walk to the ocean to the west and the bay to the east. There is easy access to parks, playgrounds, basketball courts, volleyball courts, extra parking and the boardwalk. Sea World is about a 5-10 minute drive away. This is a three bedroom plus den, single-story condo on the top floor of the building. There is elevator and stair access. The kitchen is fully stocked with all dishware, utensils, cookware, and appliances. There is also a washer and dryer in the home. Parking is a breeze with two reserved spots in the secure underground garage. Linens, bath towels, and beach towels are all included. All you need are your personal toiletries.Each bedroom has a flat screen TV with cable. The living room has a large flat screen TV with cable, DVR, and an Amazon Fire Stick. There is a propane powered BBQ on the front patio.Two of the bedrooms have king beds. The third bedroom has two queen beds. The den has a queen-sized pull out sofa. The sofa bed has a special inflatable mattress for added comfort. As a den, this space has an open floor plan keeping with the airy quality of the home. For privacy as a bedroom, the walls retract to create a screened room. There is also a queen-sized plush air mattress available. The condo sleeps 10 comfortably, but can accommodate up to 12 guests. We manage several units of different sizes and decor in the same building.PROPERTY RULES:TERMS AND CONDITIONSThis agreement is made between Dana Horne Realty, Agent for the owner, and Guests.In order to maintain compliance with CA BRE standards, any rental lasting 30 days or longer MUST be accompanied with a separate lease agreement. In this case, Dana Horne Realty retains the right to request a refundable security deposit in place of the damage waiver fee. These long-term rentals are not subject to 10.5% TOT tax, pet fees, or cleaning fees, but additional cleaning may result in similar charges being taken from the security deposit.Occupancy:• THE NUMBER OF OCCUPANTS SHALL NOT EXCEED THE NUMBER LISTED IN THE RESERVATION REQUEST. Fees of $100 per additional occupant per day may be charged. Day guests are welcome provided day guests adhere to all rules and regulations assigned to registered guests and the total number of persons does not violate any HOA or fire safety regulations.• If it is brought to our attention that there are unregistered/unauthorized guests and/or an event on the premises and/or any violation of other terms and conditions, agent reserves the right to enter the property to review the situation and impose fines and fees if necessary.• Overcrowding, misrepresentation, or failure to comply with the Terms and Conditions of this agreement is grounds for immediate revocation of the license to the property and removal of all parties without refund.Minors:• Reservation of a property may not be made by or for anyone under 18 years of age.• Parents/guardians are responsible for their minor children and MUST be present at the property with their minor children at all times.• Parents/guardians may not allow a child to roam free on the balconies, climb on the furniture, or be unsupervised at any time.• Parents/guardians take full responsibility for all lost or broken items and damages of any kind to the property by their minor children. Damage Waiver and Security Deposit:Dana Horne Realty requires that Responsible Party purchase a $50.00 damage waiver plan. This protects you from accidental damages up to $1000.Dana Horne Realty reserves the right to impose fines/fees including but not limited to the following terms and conditions.Responsible Party agrees that:• There will be no parties, weddings or other events without the written consent of the owners. Unauthorized events will result in an additional charge of a minimum of $1,500.00 per occurrence.• Responsible Party shall incur a $100 charge for each instance of lost keys and/or garage door openers.• Responsible Party and all guests will follow the 10:00 p.m. - 7:00 a.m. noise ordinance for San Diego. Excessive noise can result in police enforcement and fines. Any enforcement action taken by police, the city, and/or the homeowner/condominium association are at the sole risk and expense of the registered Responsible Party and may result in excess damage cost. Noise offenders are subject to immediate eviction and forfeiture of all monies paid. • ANY additional cleaning charges, damage, or theft of property not covered by the damage insurance policy will be charged to the credit card on file.• Excess garbage will not be left in the rental unit upon check-out. (Please refer to the information provided in the Property Guide found in the unit for directions on how to dispose of your garbage). There is no curbside recycling. Failure to remove your trash from the property before your departure will result in appropriate charges to your credit card.• Check-in time is 3:00 PM. Check-out time is 10:00 AM. There will be NO EARLY CHECK-INS OR LATE CHECK-OUTS without prior approval. Each violation of check-in or check-out time will result in a fee of $50.00 per 15 minute infraction. • There will be NO PETS in the home or on the property at any time without written permission of the owner. If a pet has been approved, responsible party agrees that the pet fee does not cover any damage caused by the pet. Any costs related to the presence of the pet will be charged to the credit card on file.• There will be NO SMOKING on the property.• There will be NO CATERING OR OUTSIDE MUSIC PERMITTED without the prior written consent of the owners.• Responsible Party will limit the number of cars parked on the property to the assigned parking spaces. Any unauthorized vehicles and/or use of parking spaces not explicitly assigned to the property you have rented will be towed immediately at the vehicle owner's expense.Property Care and Inspection:• Responsible Party is required to test all smoke detectors upon check-in and promptly report inoperative smoke detectors to Dana Horne Realty. • Guest(s) assume the entire risk of injuries arising from use of the property.• After inspection by guest, all problems, including inadequate cleaning and/or damage must be reported in writing to Dana Horne Realty within 24 hours of check-in in order for prior Responsible Party to be held responsible. • Owner(s) or their agents may enter the property with a 24 hour notice to make necessary/requested repairs.Limitations on Rental:• Dana Horne Realty and/or owner will not relocate, pro-rate or refund in the event of unforeseen circumstances including but not limited to appliances or air-conditioning/heating failure, other mechanical failure, unfavorable weather, disruption of utility services including cable television, etc. Dana Horne Realty will make all reasonable efforts to alter unforeseen circumstances that are within their control to a satisfactory level in accordance with Responsible Party. • In the event Dana Horne Realty is unable to deliver the property to the Responsible Party because of property sale, property owner decision, fire, mandatory evacuation, eminent domain, acts of nature, or if the property is unavailable due to construction delays or lack of utilities, Responsible Party agrees that Dana Horne Realty's sole liability, as a result of any of these conditions, will be a full refund of all payments tendered by Responsible Party.• Responsible Party and Dana Horne Realty agree that in the case of double booking or occupancy by owner, Responsible Party will be ONLY entitled to a full refund of all monies previously tendered by Responsible Party. If Dana Horne Realty is able to relocate guests, Responsible Party agrees to pay the difference in the rental amount, should Responsible Party accept alternate accommodations.• Responsible Party expressly acknowledges that in no event will Dana Horne Realty be held liable for any other condition out of the control of Dana Horne Realty or the Owner, or for any incidental or consequential damages, including but not limited to, expenses that result from moving or for any other losses. Additional Terms and Conditions:• Rates do not include excessive cleaning upon departure (i.e.: upholstery or rug shampooing, etc.).• Owner(s) reserve the right to cancel or rescind any rental agreement if it is found that the guests are conducting unlawful activities.• Responsible Party shall be liable for all acts of the family, invitees, and guests present on the property. Should there be any legal action arising from/relating to occupant(s) use of residence, owner shall be entitled to recovery of all legal fees and costs.• Owner(s) will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services, except as noted in Cancellation Policy.• Owner(s) will in no way be responsible or liable for personal property lost due to theft, flood, fire, unforeseen circumstances or natural disasters.• Any misrepresentation about the nature or size of the group, use of the property, or any other misrepresentation in any way places Responsible Party in breach of this rental agreement and is grounds for immediate termination of the rental agreement and forfeiture of all monies paid.• Owner(s) reserve right to relocate guest(s) to another rental, based on availability, or offer refund if house is not approved by the guest(s) due to an emergency, fire, sale, unforeseen circumstance, or natural disaster.• There will be NO SUBLETTING or ASSIGNING to other parties.• Some vacation rentals may also be available for sale and therefore may require a realtor to show the property. In this case, Responsible Party agrees to allow a showing to be scheduled at an agreed-upon time with reasonable notice.BEDROOM #1 DESCRIPTION:The living area is roomy enough to use the provided air mattresses or Pac N' Play stored in the bedroom closets.BEDROOM #2 DESCRIPTION:Wake up to gorgeous views from the master bedroom with flat screen TV, and electric wall mounted fireplace to warm you up on cool nights or simply add a touch of ambiance. The master bath boasts ocean views and a dual shower head steam shower.BEDROOM #3 DESCRIPTION:Our guest bedroom with comfy king bed offers eastward views of Mission Bay. Amenities include a flat screen TV and an electric fireplace.BEDROOM #4 DESCRIPTION:This guest bedroom has east facing views with private entrance from the patio area.
